Marcel Barthel (El Grande Americano, Ludwig Kaiser) is claiming self-defense in his battery case.
Barthel’s lawyer submitted a motion today claiming that under Florida’s Stand Your Ground law the charge against him should be dismissed.
Stand Your Ground is a law that allows someone to use reasonable force in self-defense without first trying to retreat and in states like Florida it can even protect them from being prosecuted if their actions are found to be legally justified.
Barthel has plead not guilty to the battery charges.
Plaintiff Richard Reap claims that he entered an elevator in which Barthel and a woman were “uncontrollably intimate” manner. He says he told them to exercise better judgement and in response to that Barthel punched him, threw him on the ground and threatened him.
According to Barthel, it was Reap who made offensive comments to him and his girlfriend, Mexican-American Andrea Bazarte. Barthel has accused Reap saying: “Have some respect before I call ICE on that bitch.”
Barthel says he confronted him but he did not attack him even after Reap threw a bottle at him.
Barthel’s attorneys have asked for the video footage from the apartment complex which they say will prove their client’s innocence.
