The band American Nightmare is suing Cody Rhodes, the WWE and Fanatics. The band asserts that they own the trademark to “American Nightmare” and are alleging the parties committed “trademark infringement, breach of contract, and deliberate interference with contractual agreements.”

American Nightmare is a punk band from Boston.

Wesley Eisold, the lead singer of the band, has held the trademark on the name since since 2016 and worked with Rhodes and AEW back in 2019 so they could use the name. They entered into another agreement in 2021 but Eisold claims the terms of their contract, agreement have been violated.

Eisold claims that one of those terms was using the “American Nightmare” name but making sure to directly reference Rhodes as a wrestler. Eisold also cites confusion in the marketplace by saying that some wear Rhodes’ merchandise to his band’s concerts and that his band is regularly tagged on social media in stories about him. Eisold is seeking at least $150,000 in damages and treble damages of up to $300,000 for federal trademark infringement, in addition to attorneys’ expenses
